A long-serving Federal Bureau of Investigation intelligence specialist has brought legal action stating his let go because of displaying a Pride flag within his workstation.
Based on the former employee, that was employed in the agency for 16 years, the firing earlier this year was “unconstitutional and politically motivated”.
The complaint argues that the agency breached the plaintiff’s free speech freedoms and engaged in retaliatory measures against him because of expressing legally safeguarded expression.
The former specialist is seeking a legal ruling to return his job within the agency.
The comprehensive filing, submitted in a Washington court for the District of Columbia, alleges that Maltinsky was terminated from the FBI academy last month because of before displaying the Pride symbol in his workspace.
According to the complaint, the LGBTQ+ banner was presented to the plaintiff to honor his efforts to support the agency’s diversity initiatives.
Since childhood, all I have wanted to do was to serve my country and protect public safety alongside the talented and committed personnel in the bureau,” said the plaintiff.
He continued, I exhibited that Pride flag – which once was displayed at the Wilshire federal building – not to make a political point, but as a symbol of acceptance, solidarity and impartial service.
These ideals that helped build the bureau effective. Currently it stands as where people like me are singled out. I am convinced I was dismissed not due to who I am, but rather because of what I represent: an openly gay individual,” he said.
Recently, the plaintiff was enrolled in the bureau’s agent training program in Virginia, before what he described as “sudden termination only weeks prior to completion”.
The lawsuit also claims that at some point following the 2017 inauguration, another employee expressed a complaint to Maltinsky’s direct supervisor concerning the exhibition of the Pride flag.
“Out of an abundance of caution, the employee asked that the top lawyer at the L.A. office examine whether the presence of the Progress Pride flag was permissible,” the filing noted.
It added, The legal officer advised the plaintiff that the display of the banner was not against the agency’s standards.”
Despite this, on the first of October, the employee received notice of his firing.
In a letter mentioned in the complaint, FBI director the director commented, “I have determined that you demonstrated improper judgment with the presence of a partisan emblem at your workstation during your previous assignment in Los Angeles.
“Pursuant to Article II of the Constitution, and the laws of the nation, your employment at the bureau is now ended.”
In a statement released on Wednesday, Maltinsky’s lawyer his counsel said, The current leadership’s unlawfully firing him forms part of an extensive initiative to purge public offices of employees that possess divergent opinions, or represent marginalized groups, or those who challenge bias.
“David’s fight is not just about him, but about securing the rights and freedoms of all public servants.”
The FBI refused to respond about the legal action.
The case is subsequent to an additional filing submitted earlier by three former high-level bureau employees who alleged they’d been unlawfully fired.
They stated that the director stated he had been instructed by the president’s office to fire any employee participating in an inquiry regarding the former president.
